Conditions of sale
All orders, contracts and quotations are subject to our standard conditions of sale. The information and statements provided are indicative only and do not form part of any offer or contract whatsoever.
Law
The contracts between Loft46 and the customer must be considered subject in their entirety to Italian law, unless otherwise agreed in writing.
Terms and conditions
This document reports the general terms and conditions on the basis of which users are offered the use of the Loft 46 Website which offers a catalog of used vintage objects with the possibility of purchasing them.
1. Definitions
To allow for complete understanding and acceptance of these terms and conditions, the following terms, in singular and plural, will have the meaning indicated below:

Loft46: Alias of the Owner previously described.
Application: The Loft 46 Website
Products: the products provided to the user by the Owner
User: any person who accesses and uses the Application
Consumer User: the adult natural person who concludes a contract for purposes unrelated to his/her business entrepreneurial, commercial, artisanal or professional activity possibly carried out
Conditions: this contract which governs the relationships between the Owner and the Users and the sale or supply of the Products offered by the Owner through the Application.
2. Scope of application of the Conditions
Use of the Application constitutes acceptance of the Conditions by the User. If the User does not intend to accept the Conditions and/or any other note, legal notice, information published or referred to therein, he/she may not use the Application or the related services.
The Conditions can be modified at any time.
The applicable Conditions are those in force on the date of transmission of the purchase order or request for supply of a Product.
Before using the Application, the User is required to carefully read the Conditions and save or print them for future reference.
The Owner reserves the right to vary at its own discretion, at any time even after the User's registration, the graphic interface of the Application, the Contents and their organization, as well as any other aspect that characterizes the functionality and management of the 'Application, communicating to the User, where necessary, the relevant instructions.
3. Purchase or request for supply via the Application
All the Products offered through the Application are described in detail in the relevant product pages (quality, characteristics, availability, price, delivery times and costs, additional charges, etc.).
There may be some errors, inaccuracies or small differences between what is published on the Application and the actual Product. Furthermore, any images of the Products are only representative and do not constitute a contractual element.
Purchases and/or requests for the supply of one or more Products via the Application are permitted to PRIVATE Consumer Users.
Purchases and/or supply requests are permitted for natural persons only on the condition that they are adults. For minors, each purchase and/or request for the supply of Products through the Application must be examined and authorized by the parents or those exercising parental responsibility.
The offer of the Products via the Application constitutes an invitation to offer and the order sent by the User will be valid as a contractual purchase proposal and/or supply request, subject to confirmation and/or acceptance by the Owner as described in following. Therefore, the Owner will have, at his sole discretion, the right to accept or not accept the User's order without the latter being able to object or complain about anything for any reason and/or reason.
The contract of sale or supply of the Products is considered concluded with the acceptance by the Owner of the User's contractual proposal. The Owner will accept the User's contractual proposal by sending the order confirmation to the email address indicated by the User or by viewing an order confirmation web page, which will contain the date of the order. order, the User's data, the characteristics and availability of the Product, the price or the method of calculating the price, any additional charges and taxes, the delivery address, the times and any delivery costs, the methods for exercising the right of withdrawal or its possible exclusion and the guarantee.
The contract for the sale or supply of the Products is not considered effective between the parties in the absence of what is indicated in the previous point.
In the event that the Product is not available, the Owner will inform the User of the new delivery or supply terms, asking whether he intends to confirm the order or not. It is understood that the contract will be considered finalized in relation to the Products accepted by the Owner.
4. Product Descriptions
The information regarding the products is obtained directly from the manufacturers of the products themselves when present. We feel free to modify this information with omissions or additions in order to provide a more detailed and clear description of each product without prior notice.
In the event that any errors or discrepancies are found, please report it via email to sales@loft46.it in order to be able to correct it.
Loft46 reserves the right to refuse orders containing items with such errors. If an item does not correspond to the description on the site, it will be possible to return it with a subsequent refund. We invite you to visit the revocation terms page for more information.
5. Accuracy of information and prices
The Loft46 website is constantly updated. All the products on our site are photographed in the internal photographic set and described exclusively by our qualified staff.
In the event that any errors or discrepancies are found, please report it to sales@loft46.it in order to be able to correct it.
Loft46 reserves the right to refuse orders containing items with such errors. If an item does not correspond to the description on the site, it will be possible to return it with a subsequent refund. Please visit the Returns and Refunds page for more information.
6. Availability
Product availability is displayed on the dedicated page. It is not possible to purchase products that are not available in stock. In extreme cases it may happen that by selling some items through other sales channels not automatically connected to this e-commerce the item may no longer be available. In this case we undertake to refund in full the entire amount paid for the purchase.
7. Orders
Loft46 assumes that all the data provided by the user is true and correct, that the buyer is the owner of the payment method chosen for the purchase and that there is sufficient credit to complete the payment.
Once the order has been received, a confirmation email will be sent automatically to the address indicated during registration with all the order details. This e-mail does not establish the beginning of a contract between the customer and Loft46, but is only a summary of the order proposal forwarded by the buyer.
Loft46 considers itself free to accept or decline any order received. In case of refusal of the order Loft46 will contact the user and provide a full refund.
You can place orders via:
- website (faster order fulfillment than other methods);
- E-Mail to sales@loft46.it indicating registration, shipping, payment details and the items you wish to order;
- by contacting via whatsapp at +39 351 657 4776 having ready all the registration, shipping and payment data (except credit card) and the items you wish to purchase. The hours for telephone orders are Monday to Friday from 09 am to 19 pm.
8. Payment
Payment is due upon delivery or execution of the order through the application. At the request of the customer or Loft46 payment can be made in advance via online credit card payment, online banking or bank transfer.
At the request of Loft46, a deposit may be requested before delivery.
The customer is obliged to report inaccuracies in the payment information provided or indicated to Loft46.
In case the customer does not fulfill his payment obligations, Loft46 subject to legal restrictions, may exercise the right to charge the outstanding costs to the consumer.
9. Delivery and execution
Once payment has been received and receipt of payment has been verified, Loft46 immediately proceeds to prepare the order. Loft46 will take maximum care in the execution of the contract.
The place of delivery is considered to be the address that the customer made known when placing the order.
Pursuant to article 4 of these contractual conditions, Loft46 will ship accepted orders efficiently within a maximum of 30 days, unless a different delivery time has been stipulated. If delivery cannot be made, is delayed or can only be made partially, the customer will be informed within 14 days of the order date. In this case, the customer has the right to withdraw from the contract free of charge.
Pursuant to the previous paragraph, in the event of cancellation of the contract, Loft46 must reimburse the customer as soon as possible, but no later than 14 days from the date of cancellation.
The risk of loss or damage to the product is Loft46's responsibility until the moment of delivery to the consumer, unless different agreements have been made.
However, a tracking code will be sent via email to follow the status of the shipment. Loft46 is not responsible for any inconveniences or delays. However, assistance will be provided in case of problems. Shipping costs are clearly indicated in the cart, during the order confirmation procedure and are included in the Total.
Delivery to post office boxes of the Italian Post Office, free ports and military addresses is excluded.
10. Modifications, cancellations of orders
It is always possible to modify or cancel an order as long as the latter has not yet been marked "In preparation".
Once in this state, the order cannot undergo changes, neither in the address nor in the goods purchased and cannot be cancelled.
However, upon receipt of the goods, it will be possible to return them following the order withdrawal procedure (we remind you that it is possible to exercise the right of withdrawal within 14 days of receiving the order for non-personalised or tailor-made products).
11. Personal data
The entry of false, altered and/or invented data is strictly prohibited. We reserve the right to legally prosecute any type of violation or abuse, in our own interests, those of users and the institutions.
12. Prices, VAT and invoicing
Loft46, selling Antique, Modern and Art products according to Italian legislation, is obliged to issue an invoice.
For these products we are obliged to ask the buyer for the details of an identity certificate.

For each order a tax receipt with guarantee value is issued.
VAT Margin Products
The margin regime is a special VAT regime that is applied to used movable goods, antiques, works of art or collectibles.
Taxpayers who apply the margin regime must indicate on the invoice that they are operations subject to the regime referred to in the art. 36 of Legislative Decree n. 41/1995.
The invoice must be issued.
Therefore, for the transfer of these goods it is mandatory to report your tax code and identity document details in the case of a private customer, VAT number in the case of a company.
Export of Antiques and Art Objects
As defined by Legislative Decree 22 January 2004, n. 42, "Code of cultural heritage and landscape, pursuant to article 10 of law 6 July 2002, n. 137", as regards the rules governing the control of the international circulation of works, the Code of Cultural Heritage establishes which are assets that can be transferred abroad.

13. Legal deadline
The terms and conditions of Loft46 are stipulated according to Italian and European legislation.
In case of dispute arising from the interpretation or execution of these, the Customer can contact a consumer association for an amicable solution. Alternatively you can contact any other mediation service of your choice. It is also possible to use the European Small Claims Procedure. The search for an amicable resolution will not stop in any way during the period of implementation of a guarantee.
Any dispute without an amicable solution will be subject to the conflict resolution of the jurisdiction of the Court of the country in question, are governed by Italian law and subject to the exclusive jurisdiction of the courts of Italy.
14. Right to Compliance
The consumer code (Legislative Decree no. 206/2005) in art. 128-135 provides for the seller's obligation to guarantee consumers the suitability of the purchased good for the characteristics and quality offered.
The seller is therefore responsible for defects of conformity existing at the time of delivery for all products sold in his store. The lack of conformity exists when the product:
- it is not suitable for the use for which it is usually intended;
- does not conform to the description or does not possess the qualities presented by the seller;
- it is not suitable for the particular use desired by the consumer, if brought to the attention of the seller at the time of purchase and accepted by the aforementioned.
Loft46 asks the buyer, in the event that a lack of conformity is found, to stop using the product and to send an email to sales@loft46.it or to call via WhatsApp at +39 351 657 4776 , specifying the problem encountered.
In the event of non-conformity of the item, shipping costs to and from the Loft46 warehouse will not be charged to the buyer.
In accordance with art. 134 of the Consumer Code, the deadline for exercising the right is 1 year from the date of delivery.
15. Force Majeure
Without any further rights of the entrepreneur being compromised, in case of force majeure he has the right to withdraw or suspend the contract by informing the consumer in writing without any judicial intervention being implemented and without him being required to pay compensation, unless that this is unacceptable under fairness standards.
The term 'force majeure' refers to all unforeseeable events beyond the control of the entrepreneur that occur after the stipulation of the contract.
Such events are not attributable by law to the entrepreneur's responsibility.
